Changes to Canada’s Open Work Permit Criteria: What You Need to Know

On January 21, 2025, the Government of Canada will implement significant new changes to the eligibility criteria for the Open Work Permit (OWP) for spouses of international students and foreign workers. Check out the details below and understand how this could impact your journey in the country.

New Rules for Spouses of Foreign Workers

As of this date, only spouses of foreign workers who meet the following criteria will be able to apply for the OWP:

  • Workers in occupations classified as TEER 0 or 1.
  • Workers in specific TEER 2 or 3 functions, which are related to sectors with labor shortages or government priorities.

These areas include:

  • Natural and applied sciences.
  • Construction.
  • Health.
  • Natural resources.
  • Education.
  • Sports and military sectors.

The full list of occupations will be released on January 21, 2025.

Another important point: for a spouse to be eligible, the foreign worker must have at least 16 months remaining on their work visa at the time of application.

Dependent children of foreign workers will no longer be eligible for the OWP.

Rules for Spouses of International Students

The rules for spouses of international students remain the same:

Only spouses of students enrolled in master’s programs lasting at least 16 months, doctoral programs or selected and eligible professional programs may apply for the OWP.

Validity of OWPs Already Issued and Possibility of Renewal

  • OWPs granted under the current rules will remain valid.
  • If the student needs more time to complete the course or family members have received visas with a shorter validity than that of the main holder, it will be possible to renew the visas in Canada.
  • The renewal will follow the same criteria as the original visa, adjusting the validity to the main applicant’s study or work visa.

Exceptions and Alternatives

These changes do not affect:

  • Spouses of foreign workers covered by free trade agreements.
  • Those in the process of obtaining permanent residence.
